license agreement
By downloading or using any of our digital products, you agree to abide by the terms outlined in this License Agreement. braille.audio reserves the right to modify this agreement at any time, at our discretion, with or without prior notice to users or licensees. Such modifications become effective immediately upon public posting, and your continued use of our products or this site constitutes acceptance of the revised terms.
The content of these downloads remains the property of braille.audio/Braille Productions LLC (“Licensor”) and is licensed, not sold, to you as the original end-user (“Licensee”).
This non-exclusive license grants permission for a single user to use the samples or reproductions globally for the duration of the copyright protection period. Other licensees/users may also use the same samples or reproductions in their productions.
Subject to compliance with this License Agreement, the Licensor grants the Licensee a non-exclusive, non-transferable, perpetual right to use the Licensor’s sounds obtained through official stores in commercial music productions. This right is granted globally for the full copyright protection period and is limited to a single user.
What You Are Allowed:
- Licensee, who purchased the kits/loops/samples, can use the included vocals, samples, patches, loops, and kits in their own music productions, both commercial and non-commercial, in combination with other sounds, without requiring permission.
- Licensee is permitted to edit or rework the sounds and use them for commercial purposes as part of a musical composition with other sounds.
- All samples are royalty-free upon licensing and downloading from official stores. This means no royalties are owed to braille.audio once licensed.
- Licensee can monetize music containing Licensor’s samples on various platforms without royalty obligations.
- Licensee retains copyright of arrangements and original compositions made with Licensor’s sounds. However, Licensee does not own the copyright to the loops or samples, allowing multiple users to use the same samples without infringement.
No credit is required to be given to braille.audio for productions, and braille.audio is not a co-owner of Licensee’s music.
What You’re Not Allowed:
- The license is non-transferable, and unauthorized duplication, copying, lending, or reselling of products or their contents is strictly prohibited.
- Licensee may not use the sounds in isolation as sound effects or loops, or in any competitive products sold or relicensed to multiple third parties.
- Unauthorized resale of braille.audio packs is prohibited, and Licensee may not sell, lend, or give away licensed audio files to third parties.
- Illegal downloads of products do not grant permission to use the sounds in productions or releases. Only downloads from official stores are permissible under this license agreement.
It is the Licensee’s responsibility to retain proof of purchase, and Licensees/users cannot claim ownership of Licensor’s samples, lyrics, midis, or compositions in their productions or performances.
Content ID and Copyright Claims: Licensee agrees not to claim any YouTube video or SoundCloud tracks containing braille.audio samples. Licensee owns the copyright on the composition but not on the samples and midis, thus cannot claim ownership of braille.audio sounds on YouTube and SoundCloud.
YouTube allows users to remove part of the Content ID reference file. Rights holders must upload the original sound or loop from our pack to remove it from the Content ID database, enabling Licensee to claim copyright.
Licensee agrees that braille.audio is not liable for any consequences arising from Content ID, monetization, or copyright claims on various platforms by other users or licensees.
Limitation of Liability: Licensor is not responsible for any direct, indirect, or consequential loss arising from the use of our products. Licensor is also not liable for any infringements resulting from the use of our products within licensee’s compositions.
To the fullest extent permitted by law, Licensor and its affiliates shall not be liable for any damages arising from the use of products, including but not limited to loss of profits, revenue, business interruption, or any other pecuniary or intangible loss.
Licensor’s total liability under this agreement or the use of products shall be limited to the amount Licensee has paid to braille.audio or its distributors/partners for its products or services.
Licensor does not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence.
The terms of this License Agreement are governed by the laws of the United States, and any claims or disputes with braille.audio shall be subject to the exclusive jurisdiction of the federal courts of the United States.
